New Hampshire Condominium Act

Most community associations in New Hampshire are governed by the state’s Condominium Act. This document declares that community associations are not required to incorporate if they do not choose to do so. There are also no specific requirements for reporting to a government agency. The law does require associations to meet in accordance with their governing documents a minimum of once annually, though there are no requirements for Board of Directors meetings. The Condominium Act also states that a quorum of at least one-third of the voting members must be present at an annual meeting, unless the governing documents state otherwise, not to be less than one-forth of the members.

The law leaves the decision to allow non-members into membership meetings in the discretion of the HOA board. Also in the board’s discretion is the amount of a reserve study, if any, as New Hampshire’s Condominium Act does not implicitly state a requirement.
